4 SMS Messaging Terms & Consent

Everlast General Contracting uses SMS (text messaging) to communicate with customers, leads, and prospects about contracting services. This section explains exactly what you can expect from our text messaging program, how you consent, and how to opt out at any time.

How We Verify SMS Opt-In

Everlast collects explicit written consent before sending marketing SMS messages. Opt-in consent is verified through one of the following methods:

• Website form: you submit a contact or quote-request form with a checkbox that reads: “I agree to receive calls and text messages from Everlast General Contracting about my project. Message and data rates may apply. Reply STOP to cancel. Frequency varies. Consent is not a condition of purchase.”
• Text keyword: you text a keyword (for example QUOTE or START) to our business number.
• Verbal agreement: during a phone call or on-site visit, you verbally authorize us to text you — we log the date, time, and purpose of the consent.
• Written agreement: you sign a contract, proposal, or estimate that includes an SMS communications clause.

All consent records are retained for at least four (4) years in compliance with the Telephone Consumer Protection Act (TCPA) and CTIA messaging guidelines.

5 How We Share Your Information

We do not sell your personal information. We share information only in these limited cases:

• Service providers: trusted vendors who help us run our business (scheduling software, CRM, accounting, payment processors, SMS platform). These providers are contractually required to protect your data and use it only to perform their services for us.
• Subcontractors: if your project requires specialized trades (roofing, electrical, plumbing), we may share the minimum information needed to complete the job.
• Legal compliance: when required by law, subpoena, court order, or to protect our rights, property, or safety.

We do not share phone numbers collected for SMS with any third party for marketing purposes — ever.

6 Data Retention

We keep your information only as long as necessary for the purposes described in this policy, including to provide services, comply with legal obligations, resolve disputes, and enforce agreements. Lead and contact records are typically retained for up to seven (7) years. SMS consent records are retained for at least four (4) years after opt-out to demonstrate compliance.

• Correction: ask us to update or correct inaccurate information.
• Deletion: request that we delete your information, subject to legal retention requirements.

Our services are intended for adults aged 18 or older. We do not knowingly collect personal information from anyone under 18. If you believe a minor has provided us with personal information, please contact us and we will delete it.
